1. Acceptance of Terms

2xWin provides marketing consulting, fitness business automation, and client communication services to fitness businesses and gym operators. Our services may include, but are not limited to:

• Lead generation systems and automation
• Client communication and follow-up programs
• SMS and email notification services
• Workflow automation consulting
• Member management system setup and support

3. SMS Messaging Program

By providing your mobile phone number and opting in to receive text messages from 2xWin, you agree to receive recurring automated SMS/MMS messages from us, including but not limited to:

• Service notifications and updates
• Appointment reminders and confirmations
• Marketing messages related to fitness business programs
• Account and client communication alerts
• Promotional offers and program information

4. SMS Consent & Opt-In

Your consent to receive SMS messages is obtained at the point of enrollment — either through a web form, verbal agreement, or written authorization. By providing your phone number and checking the opt-in checkbox (or signing an authorization form), you expressly consent to receive text messages from 2xWin.

Consent is not a condition of purchase. You may opt out of SMS communications at any time without affecting your ability to receive our services.

Consent obtained through our programs is not shared with or sold to third parties for their own marketing purposes. Consent applies only to communications from 2xWin and its affiliated fitness business clients on whose behalf we communicate.

5. Prohibited Use

You agree not to use our services or communications channels to:

• Send unsolicited communications to others
• Violate any applicable local, state, national, or international law or regulation, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
• Impersonate any person or entity
• Engage in fraudulent, deceptive, or harmful activities
• Interfere with or disrupt the integrity or performance of our services

6. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including your phone number and messaging history.

We do not sell, rent, or share your personal information or mobile opt-in data with third parties for marketing purposes without your express consent.

All content on this website, including text, graphics, logos, templates, and automation systems developed by 2xWin, are the property of Double Win Consulting Inc and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

Results from our marketing and automation services may vary and are not guaranteed. Past performance of campaigns does not guarantee future results.

9. Limitation of Liability

To the fullest extent permitted by law, Double Win Consulting Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or revenue, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our principal place of business is Signal Hill, California. Any disputes arising from these Terms shall be resolved in the courts of Los Angeles County, California.
